OFFICE ACTION
TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
ISSUE/MAILING DATE: 12/22/2015
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
No Likelihood of Confusion
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Translation
Applicant must submit an English translation of all foreign wording in the mark. 37 C.F.R. §§2.32(a)(9), 2.61(b); see TMEP §809. In the present case, the Chinese wording “YOULI” requires translation.
The following translation statement is suggested:
The English translation of the word “YOULI” in the mark is “favorable”.
TMEP §809.03. See attached translation evidence.
The mark consists of the stylized wording YOULI featuring a design of a circle inside the curve of the letter Y. The circle is divided in half down the center and divided in half again only on the left side with part of the dividing line crossing out of the left side of the circle.
If the applicant has any questions or needs assistance in responding to this Office action, please call or e-mail the assigned examining attorney.
