The effective filing date of the pending application identified below precedes the filing date of applicant’s application. If the mark in the referenced application registers, applicant’s mark may be refused registration under Section 2(d) because of a likelihood of confusion with that registered mark. See 15 U.S.C. §1052(d); 37 C.F.R. §2.83; TMEP §§1208 et seq. Therefore, action on this application is suspended until the earlier-filed referenced application is either registered or abandoned. 37 C.F.R. §2.83(c). A copy of information relevant to this referenced application was sent previously.

REFUSAL/REQUIREMENTS CONTINUED AND MAINTAINED: The following refusal is continued and maintained: Partial Section 2(d) refusal with respect to U.S. Registration No. 4731156 (TYLTLAB).
The requirement for an acceptable identification of services is continued and maintained in Classes 035, 036, 038 and 045. The following wording is indefinite, overly broad and/or beyond the scope of the original wording and will be more fully addressed in a future communication.
IC 035: Computer services in the nature of a website featuring user profiles and information about financial transactions on the services, namely, providing an online computer website that provides commercial and personal financial transaction data and related reference information; Socially interactive website for raising funds, namely, providing a website for managing, conducting and organizing online fundraisers and sales that are designed to raise money for user selected purposes, such as payment of debts, creative projects, events, experiences, and causes
IC 036: Financial services, namely, communicating commercial transactions and payment options, and communicating payment card and disbursement transactions over an electronic communications network; Financial services, namely, communicating electronic funds transfer transactions of electronic funds via electronic communications networks; online payment services in the nature of communicating payment card transactions and disbursement transactions via a global computer network, namely, financial services in the nature of the communication of payment and disbursement transactions via an application programmable interface; Computer services in the nature of a website featuring user profiles and information about financial transactions on the services users have engaged in or are offering to other users; Providing a website where users can accept financial transactions related to the creation of goods or services, namely, providing an Internet website portal that communicates payment transactions
IC 038: provision of information relating to computer programs and API - application program interface, namely, information transmission via electronic communications networks and providing multiple-user access to a global computer information network; computer services, namely, providing online facilities for real-time interaction with other computer users for enabling users to share information and fundraising campaigns and transactions with and among websites, social networks, and email services
IC 045: Services provided to individuals in relation to social events, namely, guest management services in the nature of maintaining a list of individuals that donated towards or paid to attend the social events
The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based. TMEP §§716.04, 716.05. Applicant will be notified when suspension is no longer appropriate. See TMEP §716.04.
