This application was approved for publication on November 8, 2015.  See 37 C.F.R. §2.80.  However, approval of the application has been withdrawn to address the issue(s) below.  See TMEP §706.01.  The trademark examining attorney apologizes for any inconvenience this may cause applicant.

 

Identification of Goods

 

The wording “brackets and bars for mounting vehicle and motorcycle lights” in the identification of goods in International Class 12 must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.    For classification in Class 12, the goods must be identified as being adapted to vehicles or motorcycles or as being component parts of the same.  Otherwise, such goods are classified by material composition, as they are generally in the nature of hardware.

 

Applicant may adopt the following identification, if accurate: 

 

International Class 12:  Brackets and bars adapted to vehicles or motorcycles for mounting vehicle and motorcycle lights; horns for vehicles; windshield wiper blades for vehicles, motorcycles, trains and airplanes; vehicle wheels 

 

An applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.

Search Results – No Confusingly Similar Marks Found
