SEARCH OF OFFICE’S DATABASE OF MARKS

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

1.     Entity and Citizenship of Applicant Omitted

Applicant must specify its form of business or type of legal entity and its national citizenship or U.S. state or foreign country of organization or incorporation.  See 37 C.F.R. §2.32(a)(3)(i)-(ii); TMEP §§803.03, 803.04.  For example, an applicant can apply as an individual, a partnership, a corporation, a joint venture, or the foreign equivalent thereof.  See 37 C.F.R. §2.32(a)(3); TMEP §§803.03 et seq. 

 

If applicant’s entity type is an individual, applicant must indicate his or her national citizenship for the record.  37 C.F.R. §2.32(a)(3)(i); TMEP §803.04. 

 

If applicant’s entity type is a corporation, association, partnership, joint venture, or the foreign equivalent, applicant must set forth the U.S. state or foreign country under whose laws applicant is organized or incorporated.  37 C.F.R. §2.32(a)(3)(ii); TMEP §§803.03(b)-(c), 803.04.  In addition, if applicant is a U.S. partnership or joint venture, applicant must list the names, legal entities and national citizenship or the U.S. state or foreign country of organization or incorporation of all the general partners or joint venturers.  37 C.F.R. §2.32(a)(3)(ii)-(iv); TMEP §§803.03(b), 803.04.  For an association, applicant must also specify whether the association is incorporated or unincorporated.  TMEP §803.03(c).  The trademark examining attorney suggests, if accurate:

 

Applicant, Quintessential Brands, S.A. is a joint stock company, organized under the laws of the country of Luxembourg.

 

2.    Particular Wording Indefinite in the Identification of Goods in International Class 032

 

The wording other non-alcoholic drinks in the identification of goods is indefinite and must be clarified because the generic names of each specific item must be stated, e.g., namely, alcohol-free beers, non-alcoholic cider, non-alcoholic beverages containing fruit juices, if accurate as suggested below.  The wording, syrups and other preparations for making beverages is indefinite, as the other preparations must be clarified by stating the specific generic names for the beverages to be made must be stated, e.g.,  Syrups for making beverages and preparations for making beverages, namely, fruit drinks, if accurate.    See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  

 

International Class 032          Beers; Mineral and aerated waters and other non-alcoholic drinks, namely, alcohol-free beers, non-alcoholic cider, non-alcoholic beverages containing fruit juices; Fruit drinks and fruit juices; Syrups for making beverages and preparations for making beverages, namely, fruit drinks

 

An applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.

Please Note:  The identification is acceptable as written in International Class 033.

 

3.    Disclaimer Required of “DISTILLERY”

Applicant must disclaim “DISTILLERY” in the mark, FIVE POINTS DISTILLERY, because it merely describes the origin of applicant’s goods , and thus is an unregistrable component of the mark.  See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012) (quoting In re Oppedahl & Larson LLP, 373 F.3d 1171, 1173, 71 USPQ2d 1370, 1371 (Fed. Cir. 2004)); TMEP §§1213, 1213.03(a). 

 

A DISTILLERY is a place where strong alcoholic drinks such as whiskey are made. See definition – Exhibit 1 Therefore, DISTILLERY describes the origin of applicant’s alcoholic goods in International Class 033, is descriptive and must be disclaimed.

 

An applicant may not claim exclusive rights to terms that others may need to use to describe their goods   in the marketplace.  See Dena Corp. v. Belvedere Int’l, Inc., 950 F.2d 1555, 1560, 21 USPQ2d 1047, 1051 (Fed. Cir. 1991); In re Aug. Storck KG, 218 USPQ 823, 825 (TTAB 1983).  A disclaimer of unregistrable matter does not affect the appearance of the mark; that is, a disclaimer does not physically remove the disclaimed matter from the mark.  See Schwarzkopf v. John H. Breck, Inc., 340 F.2d 978, 978, 144 USPQ 433, 433 (C.C.P.A. 1965); TMEP §1213. 

 

If applicant does not provide the required disclaimer, the USPTO may refuse to register the entire mark.  See In re Stereotaxis Inc., 429 F.3d 1039, 1040-41, 77 USPQ2d 1087, 1088-89 (Fed. Cir. 2005); TMEP §1213.01(b).

 

Applicant should submit a disclaimer in the following standardized format:

 

No claim is made to the exclusive right to use “DISTILLERY” apart from the mark as shown. (Limited to IC 033)
