SUMMARY OF ISSUES that applicant must address:
SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SUBSTITUTE SPECIMEN REQUIRED – Class 36
THIS PARTIAL REFUSAL APPLIES TO CLASS 36 ONLY
Specifically, the specimen consists of an advertisement for an online software tool used by third-parties in the insurance field. This shows use of the mark in connection with applicant’s Class 42 services, but not applicant’s Class 36 services. The specimen does not indicate that applicant provides Class 36 insurance services for rating, quoting, underwriting, binding, or issuing insurance coverage under the mark. Rather, applicant’s specimen describes an online software tool that assists third-parties in providing insurance services to their clients: “That’s why we created ezArtisan, ezAuto, ezBOP, and ezComp, our fast and simple-to-use online rating system right at our website. These convenient tools save time and provide you with greater cross-selling opportunities.” While the specimen shows use of online, non-downloadable software for use by third parties in the insurance industry, it fails to show proper use of the applied-for mark in the sale or advertising of the identified Class 36 services.
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C).
Applicant may respond to this refusal by satisfying one of the following for each applicable international class:
(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application and (b) shows the mark in actual use in commerce for the services identified in the application.
(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fees and filing requirements such as providing a specimen.

Applicant should note the following additional ground for refusal.
CLARIFICATION OF IDENTIFICATION OF SERVICES
The wording “providing use of online, non-downloadable software” is indefinite and must be clarified to indicate that the use is temporary.
Applicant may adopt the following identification of services, if accurate:
Class 35: “Automobile and vehicle insurance price comparison rating services for others via an online, non-downloadable interface software portal.”
Class 36: “Automobile and vehicle insurance services, namely, insurance premium rate computing, providing vehicle insurance rate quotes, underwriting, binding, and issuing insurance coverage via an online, non-downloadable interface software portal.”
Class 42: “Providing temporary use of online, non-downloadable software for insurance premium rate computing, providing vehicle insurance rate quotes, underwriting, binding, and issuing insurance coverage in the field of automobiles and vehicles insurance.”

MULTIPLE – CLASS APPLICATION REQUIREMENTS
Note, in the application, applicant listed two classes, but only submitted a fee sufficient for one class.
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
The fee for adding classes to a TEAS Reduced Fee (RF) application is $275 per class. See 37 C.F.R. §§2.6(a)(1)(iii), 2.23(a). If applicant responds to the refusals, applicant must also respond to the requirement set forth below.
AMENDED MARK DRAWING REQUIRED
A clear drawing of the mark is an application requirement. 37 C.F.R. §2.52. Therefore, applicant must submit a new drawing showing a clear depiction of the mark. All lines must be clean, sharp and solid, and not fine or crowded. 37 C.F.R. §§2.53(c), 2.54(e); TMEP §§807.05(c), 807.06(a).
To submit a new drawing via the Trademark Electronic Application System (TEAS), applicant must use the response form and follow the instructions regarding submission of a drawing. TMEP §807.05(a); see 37 C.F.R. §2.53(a). An applicant must submit a drawing via TEAS in jpg format, and the USPTO recommends a digitized image with a length and width no smaller than 250 pixels and no larger than 944 pixels. 37 C.F.R. §2.53(c); TMEP §807.05(c).
For drawings submitted on paper, the paper should be approximately 8.5 inches wide by 11 inches long, white, non-shiny, and include the caption “DRAWING PAGE” at the top. 37 C.F.R. §2.54(a)-(c); TMEP §807.06(a). The mark in the drawing must appear no larger than 3.15 inches (8 cm) high by 3.15 inches (8 cm) wide. 37 C.F.R. §2.54(b); TMEP §807.06(a). Further, the drawing must be made with ink or by a process that will provide a high definition when scanned. 37 C.F.R. §2.54(e); TMEP §807.06(a). A photolithographic, printer’s proof copy, or other high-quality reproduction of the mark may be used. 37 C.F.R. §2.54(e); TMEP §807.06(a).
The USPTO will not accept amendments or changes to the applied-for mark shown in a new drawing if the changes would materially alter the mark. 37 C.F.R. §2.72; see TMEP §§807.13 et seq., 807.14.

ASSISTANCE
TEAS PLUS OR TEAS REDUCED FEE (TEAS RF) APPLICANTS – TO MAINTAIN LOWER FEE, ADDITIONAL REQUIREMENTS MUST BE MET, INCLUDING SUBMITTING DOCUMENTS ONLINE: Applicants who filed their application online using the lower-fee TEAS Plus or TEAS RF application form must (1) file certain documents online using TEAS, including responses to Office actions (see TMEP §§819.02(b), 820.02(b) for a complete list of these documents); (2) maintain a valid e-mail correspondence address; and (3) agree to receive correspondence from the USPTO by e-mail throughout the prosecution of the application. See 37 C.F.R. §§2.22(b), 2.23(b); TMEP §§819, 820. TEAS Plus or TEAS RF applicants who do not meet these requirements must submit an additional processing fee of $50 per international class of goods and/or services. 37 C.F.R. §§2.6(a)(1)(v), 2.22(c), 2.23(c); TMEP §§819.04, 820.04. However, in certain situations, TEAS Plus or TEAS RF applicants may respond to an Office action by authorizing an examiner’s amendment by telephone without incurring this additional fee.
