EXPLANATION OF FILING

 

REQUEST FOR CORRECTION UNDER §7(G) OF THE TRADEMARK ACT

 

McMillen Jacobs Associates, owner of the registration identified above, hereby petitions for correction of the Registration under Section 7(g) of the Trademark Act and Rule 2.174.  As will be shown, the material mistake was incurred through the fault of the Patent and Trademark Office.  This mistake was made in the dates of use for Class 35.

There is an error in the Certificate of Registration and TSDR records.  Registrant filed its Allegation of Use on November 18, 2016 and inserted its dates of first use and use in commerce in Class 35 to read as “6/00/2015”.  The date of use in commerce for Class 35 was incorrect.  It reads “in commerce 6-00-2016” and should read:

Registrant respectfully requests that it is issued a corrected Certificate of Registration and that the TSDR record be updated accordingly for Registration No. 5,125,151.
