To the Commissioner for Trademarks:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

In the Office Action, the Examining Attorney requested additional information about the Applicant's goods. Attached to this office action request are the various labels used by the Application. As can be seen from the labels, the products are nicotine e-liquid. The products do not contain marijuana, CBD, THC, marijuana-based preparations, marijuana extracts or derivatives.

The Examining Attorney also requested responses to several specific questions:

· Do the goods have an ingredient label or list? Provide an ingredient label or a certificate of analysis of the ingredients.

See attached.

· Do applicant’s identified goods include or contain marijuana, marijuana-based preparations, marijuana extracts or derivatives which are derived from any part of the plant Cannabis sativa L other than the mature stalks or sterilized seeds or any other illegal controlled substance?

No.

· Do applicant’s identified goods include or contain any cannabinoid, such as but not limited to, tetrahydrocannabinols (THC), cannabinols (CBN), and/or cannabidiols (CBD)?

No.

· Do applicant’s identified goods include or contain any ingredient from the flowering tops, resin, or leaves of the cannabis plant?

No.

· Do applicant’s identified goods comply with the Controlled Substance Act (CSA)?
