Miscellaneous Statement
On February 5, 2006 Heather Granata, one of the principals of the current Applicant, Little Adventures, LLC, filed U.S. Trademark Application No. 78/807,390 under Section 1(a) for the mark LITTLE ADVENTURES in International Class 025 for children's clothing and children's costume clothing. The application stated that the mark was first used at least as early as December 1, 2003 and that it was first used in commerce at least as early as September 1, 2005. Registration of the mark LITTLE ADVENTURES occurred on July 17, 2007 as Registration No. 3,264,470. The mark LITTLE ADVENTURES has been used continuously by Heather Granata and her partner, Jennifer Harrison since April 1, 2003 as a trademark for dress-up costumes and dress-up toys. By the end of 2014, the LITTLE ADVENTURES, LLC had achieved annual sales of $6 million. The filing of a Section 8 Affidavit alleging continued use of the mark LITTLE ADVENTURES was due no later than July 17, 2013. As the Section 8 Affidavit was inadvertently not filed, Registration No. 3,264,470 for the mark LITTLE ADVENTURES was cancelled on February 5, 2014. On September 18, 2014, a new trademark application Serial No. 86/399028 was filed by the undersigned attorney for the mark LITTLE ADVENTURES in International Class 025 for capes, cloaks, costumes for use in children's dress up play, Halloween costumes, and Halloween costumes and masks sold in connection therewith. On January 2, 2015, the application was rejected on the grounds that there was a likelihood of confusion with the mark THE LITTLE ADVENTURE, which was registered by Rees-Jones Blythe on July 26, 2011. Today, May 15, 2015, a Petition to Cancel U.S. Trademark Registration No. 4,003,740 for the mark THE LITTLE ADVENTURE in International Class 12 and International Class 28 is being filed with the U.S. Trademark Trial and Appeal Board.
