SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Applicant must respond to the following Requirement.

 

INFORMALITIES

 

IDENTIFICATION AND CLASSIFICATION OF GOODS (CLASS 008 AND 009 ONLY)

 

The identification of goods is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses.

 

The examining attorney notes Classes 001, 011, and 012 are definite as written.

 

The current wording used to describe the goods needs clarification because of the following:

 

“Manually operated shop tools for work on bicycles,” is indefinite as Applicant must specify the function of the tools or specify the tools with more detail.

 

“GPS devices,” is indefinite as Applicant must specify the type of GPS devices.

 

Applicant may adopt the following identification, if accurate (changes are in bold): 

 

Class 008:  Manually operated shop tools for repair and maintenance on bicycles

 

Class 009:  GPS navigation devices; batteries for LED lights; battery chargers; USB cables

 

An applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.

PARTIAL ABANDONMENT ADVISORY

 

If applicant does not respond to this Office action within the six-month period for response, the following goods 008 and 009 will be deleted from the application: 

 

Manually operated shop tools for work on bicycles

 

GPS devices

 

The application will then proceed with the following goods in International Classes 001, 009, 011, and 012 only: 

 

Class 001:  Carbon dioxide (CO2) filled cartridges

 

Class 009:  batteries for LED lights; battery chargers; USB cables

 

Class 011:  LED lights for bicycles and bicycle tools

 

Class 012:  Bicycle helmet, handlebar and seat post mounts for LED lights; carbon dioxide (CO2) tire inflators
