SEARCH OF OFFICE’S DATABASE OF MARKS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
COLOR CLAIM AND COLOR DESCRIPTION MUST BE AMENDED
A complete color claim must reference all the colors appearing in the drawing of the mark. See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq. Similarly, a complete mark description for a mark depicted in color must identify all the literal and design elements in the mark and specify where the colors appear in those elements. See 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a) et seq
The following color claim and mark description are suggested, if accurate:
Color claim: “The colors green, white and gray are claimed as a feature of the mark.”
Mark description: “The mark consists of the following: the stylized wording "SCOTTS" in white against a green oval background outlined in white and gray.”
IDENTIFICATION OF GOODS FOR CLASS 21 MUST BE AMENDED
Raised garden beds, namely, raised containers for planting contained gardens; compost bins for household use
The wording for class 20 is acceptable as written.
