  • Search Results

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

  • Identification of Goods

 

The wording “clothing” in the identification of goods must be clarified because it is too broad and could include goods in several international classes.  See TMEP §§1402.01, 1402.03.  Examples of acceptable identifications include the following:  “clothing for protection against accidents, irradiation and fire” in International Class 9; “surgical gowns” in International Class 10; “pet clothing” in International Class 18; and “shirts, shorts and pants” in International Class 25.  Therefore, applicant must amend the identification to specify the type of clothing.

 

If applicant’s clothing is classified in International Class 25, applicant should insert the word “namely,” after “clothing” and indicate the specific types of clothing items (e.g., shirts, pants, coats, dresses).

 

The following is an amended version of applicant’s identification of goods that complies with the above-mentioned clarification requirements, with additions and alterations in bold type.

 

Applicant may adopt the following identification of goods, if accurate:

 

CLASS 10: Clothing, namely, surgical gowns

 

CLASS 25: Clothing, namely, {specify the common commercial name of goods belonging in Class 25, e.g., shirts, pants}; footwear; headwear

 

An applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.

ADVISORY: MULTIPLE-CLASS APPLICATION

 

The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).  The application identifies goods that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class.  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

  • Prior Registration Claim

 

Applicant’s claim of ownership of U.S. Registration No. 3474158 will not be printed on any registration which may issue from this application because Office records show that the claimed registration is cancelled.  Only claims of ownership of active registrations are printed.  See 37 C.F.R. §2.36; TMEP §812.
