THIS IS A FINAL ACTION.
This Office action is in response to applicant’s communication filed on August 21, 2015. Applicant’s amendments have been received and entered. The following issues remain:
IDENTIFICATION AND CLASSIFICATION OF SERVICES
The items that are in bold require amendment, deletion or reclassification.
Class 9: computer software in the field of financial services for managing, analyzing, and performing tasks related to data, data processing equipment, computers, and computer application software for devices capable of accessing the internet, including general computing devices, server computers, personal computers, and mobile devices, namely software for use in managing, analyzing, and performing tasks related to data
Including is indefinite as it could include goods in other international classes and must be replaced with the word namely.
Class 41: education and training provided through use of written material, electronic material, classes, and individualized sessions; electronic publications comprising books, magazines, articles, posts, emails, newsletters, and web pages in the field of data analytics
Applicant must specify the topic that the education and training that is provided on. Such as education and training provided through use of written material, electronic material, classes, and individualized sessions in the field of accounting.
Class 45: analyzing data in computer databases for research and development, business, accounting, and marketing purposes
As previously stated, this identification might have resulted in many international classes. Analyzing data in computer databases for research and development in the fields of business and marketing is in Class 35.
Analyzing data in computer databases for research and development in the field of accounting is in Class 36.
Applicant may add the Class 35 part to the current identification of services and amend Class 45 to Class 36 if the above suggestions are acceptable.
An applicant may only amend an identification to clarify or limit the services, but not to add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.
(1) A response that fully satisfies all outstanding requirements and/or resolves all outstanding refusals.
(2) An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.
