The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

SUMMARY OF ISSUES

 

Registration is refused pending a requirement to clarify the identification of goods. 

 

SEARCH OF OFFICE’S DATABASE OF MARKS

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

IDENTIFICATION AND CLASSIFICATION OF GOODS

 

There is an issue with classification.

 

The wording must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03. 

 

An identification for “system” in the identification of goods must list the primary parts or components of the system and describe the nature, purpose, or use of the system.  TMEP §1401.05(d).  Applicant should use common generic terms to specify the parts or components of the system.  See TMEP §§1402.01, 1402.03(a).  Applicant should also classify the system in the same international class as its primary parts or components.  TMEP §1401.05(d).  Generally, the items listed first is viewed as the primary component that determines classification.

 

In applicant’s case, “air freshening systems comprised of an air freshening preparation, a container, and refills for the container” appears to be improperly classified in Class 11.  The list of components is somewhat indefinite and creating a problem as to classification. 

 

The term “air freshening preparation” appears first on the list of components and should be considered the primary component of the air freshening system.  It determines classification.  However, the wording “air freshening preparation” is vague and indefinite.  These could be considered to be “air fragrancing preparations” or “room fragrancing preparations” in Class 3, or “air deodorizing preparations” in Class 5 since the term “air freshening” is broad.  Applicant must amend to clarify the nature of the component and classify accordingly.  Note that the wording “container, and refills for the container” are a bit unclear as well.  Generally, these could be identified as “dispensing units for air fresheners” or “electric dispensers for air fresheners and deodorizers,” which are Class 11 goods.  The “refills for electric and non-electric room fragrance dispensers” are in Class 3.  Because the system includes goods that are classified in multiple classes, it is important for applicant to list the main/primary component first and let that determine classification of the entire air freshening system. 

 

The wording “odor neutralizing and control systems comprised of an odor neutralizing and control preparation, a container, and refills for the container” also appears to have an issue as to classification.  The primary component appearing first on the list of components is “odor neutralizing and control preparation,” and this item is properly classified in Class 5.  Note again that the wording “container, and refills for the container” are a bit unclear as well.  For example, “dispensing units for room deodorants” are in Class 11, and refills for odor neutralizing preparations would be in Class 5 where the odor neutralizing preparations are classified. 

 

Applicant must correctly classify the goods and in this case may delete some wording in order to keep the application in only one International Class.  Should applicant be interested in adding International Classes,  the guidance is as follows.  The application identifies goods and/or services in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on Trademark Act Section 1(b):

 

(1)       List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.

 

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).  The application identifies goods and/or services that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class(es).  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.

RESPONSE GUIDELINES

 

If applicant has questions regarding this Office action, please telephone or e-mail the assigned trademark examining attorney.  All relevant e-mail communications will be placed in the official application record; however, an e-mail communication will not be accepted as a response to this Office action and will not extend the deadline for filing a proper response.  See 37 C.F.R. §2.191; TMEP §§304.01-.02, 709.04-.05.  Further, although the trademark examining attorney may provide additional explanation pertaining to the refusal(s) and/or requirement(s) in this Office action, the trademark examining attorney may not provide legal advice or statements about applicant’s rights.  See TMEP §§705.02, 709.06.

 

For this application to proceed toward registration, applicant must explicitly address each refusal and/or requirement raised in this Office action.  If the action includes a refusal, applicant may provide arguments and/or evidence as to why the refusal should be withdrawn and the mark should register.  Applicant may also have other options for responding to a refusal and should consider such options carefully.  To respond to requirements and certain refusal response options, applicant should set forth in writing the required changes or statements. 

 

If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to register, and the application fee will not be refunded.  See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a), 2.209(a); TMEP §§405.04, 718.01, 718.02.  Where the application has been abandoned for failure to respond to an Office action, applicant’s only option would be to file a timely petition to revive the application, which, if granted, would allow the application to return to live status.  See 37 C.F.R. §2.66; TMEP §1714.  There is a $100 fee for such petitions.  See 37 C.F.R. §§2.6, 2.66(b)(1).
