The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

More Complete Description of the Mark Required

 

The applicant submitted a description of the mark referencing color, but a more complete description is required.  Specifically, applicant must indicate if the color white is a feature of the mark or if it is background area. 

 

Applicant may consider the following description, if accurate:

 

• The mark consists of the term "OMAG" in red block letters inside an outline in blue consisting of a straight horizontal line at the bottom of the outline, straight verticals lines on each side of the outline, and three turret-shaped designs at the top of the outline.  The color white represents background area and is not part of the mark.
