DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On June 6, 2015, the trademark examining attorney and David Oberdick discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
MULTIPLE – CLASS APPLICATION REQUIREMENTS
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp). The application identifies goods and/or services that are classified in at least 2 classes; however, applicant submitted a fee(s) sufficient for only 1 class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid. The fees for adding classes to an application are $325 per class when the fee is paid using the Trademark Electronic Application System (TEAS) and $375 per class when the fee is paid in a paper submission. See 37 C.F.R. §2.6(a)(1)(i)-(ii); TMEP §§810, 1403.02(c).
(3) Submit verified dates of first use of the mark anywhere and in commerce for each international class.
(4) Submit a specimen for each international class. The current specimen is acceptable for class 17; and applicant needs a specimen for class 7.
Examples of specimens for goods include tags, labels, instruction manuals, containers, and photographs that show the mark on the actual goods or packaging, or displays associated with the actual goods at their point of sale. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods.
(5) Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.”

IDENTIFICATION OF GOODS
The identification of goods is amended to read as follows:
International Class 7
automatic lubrication systems, namely, automatic lubrication machines; automatic lubrication systems comprising of lubricating pumps, lubricant measuring valves being parts of machines, valves being parts of machines, timers, meters, and hose assemblies, namely, hoses, hose fittings and hose adaptors, all sold as an integral component of the automatic lubrication systems.
International Class 17
Flexible industrial hoses, namely industrial and hydraulic hoses comprised primarily or wholly of rubber, plastics, fabrics, composites of rubber, composites of plastics, composites of fabrics, wire-reinforced rubber, wire-reinforced plastics, and wire-reinforced fabrics for use in mining, oil and gas industries and industrial specialty applications; hose fittings for use in mining, oil and gas industries and industrial specialty applications; and hose adaptors in the nature of non-metal couplings for use with industrial and hydraulic hoses in mining, oil and gas industries and industrial specialty applications.
