Request for Reconsideration after Final Action

To the Commissioner for Trademarks:

Application serial no. 86411543 CHROMAXTEND(Standard Characters, see http://tmng-al.gov.uspto.report/resting2/api/img/86411543/large) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Registration on the Principal Register has been refused under Section 2(e)(1), on the ground that the mark “merely describes a feature or purpose of applicant’s goods.”  Applicant respectfully maintains that the trademark is not merely descriptive and that CHROMAXTEND can have many meanings in connection with hair care products. 

 

Applicant has filed an Amendment to Allege Use and the same has been accepted.

 

Applicant is amending its application to request registration on the Supplemental Register, and respectfully requests that a registration be granted.

The applicant seeks registration of the mark on the Supplemental Register (i.e., a change of the words 'Principal Register' to 'Supplemental Register').
