The statement of use has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Specimen(s) Submitted with Statement of Use Is/Are Unacceptable – Classes 19, 20, and 31 Only
Registration is refused because the specimen does not show the applied-for mark in use in commerce in International Class(es) 19, 20, and 31. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods identified in the application or Statement of Use. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Specifically, the specimens for the goods in these International Classes are mere advertising. To be point-of-sale displays the specimens must have an invitation to purchase and list how or where to order the goods, not merely to find out information about the goods. All of the specimens merely have information about the goods, and even where to find out information about the goods. However, none of the specimens has an invitation to order, and the place to order the goods.
Examples of specimens for goods include tags, labels, instruction manuals, containers, photographs that show the mark on the actual goods or packaging, and displays associated with the actual goods at their point of sale. See TMEP §§904.03 et seq. Webpages may also be specimens for goods when they include a picture or textual description of the goods associated with the mark and the means to order the goods. TMEP §904.03(i). However, leaflets, handbills, advertising circulars, and other advertising materials generally are not acceptable specimens for goods. See TMEP §§904.03 et seq.
Applicant must respond to this refusal by satisfying the following:
(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce prior to the expiration of the time allowed applicant for filing a statement of use, and (b) shows the mark in actual use in commerce for the goods identified in the application.
(2) The following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: "The substitute specimen was in use in commerce prior to the expiration of the time allowed applicant for filing a statement of use." 37 C.F.R. §2.59(b)(2); TMEP §904.05. If submitting a specimen requires an amendment to the dates of use, applicant must also verify the amended dates. 37 C.F.R. §2.71(c).

To submit an amended verified dates of first use online using the Trademark Electronic Application System (TEAS), applicant should answer "yes" to the TEAS response form wizard question to "add/modify dates of first use" These steps appear on different pages of the TEAS response form.
Statement of Use May Not Be Withdrawn
Applicant may not withdraw the statement of use. 37 C.F.R. §2.88(g); TMEP §1109.17.
Only If Applicable - Examiner’s Amendment Recommended
Examiner’s Amendments cannot be issued for partial amendments. However, if all of the outstanding issues can be resolved through an Examiner’s Amendment, the applicant is encouraged to respond to this Office Action by amending the application in a telephone call with the examining attorney to expedite the processing of the application.
