MISCELLANEOUS STATEMENT | Applicant has resubmitted the specimen attached to its May 27, 2015 office action response with the four webpages that follow the original submission. Applicant respectfully submits that the webpages submitted herewith show use of the mark BCAUSE. BCAUSE is used at the top of each of the first three webpages submitted, and in each case it is followed by a separate slogan that starts on a separate line, i.e., "Sustainability is comprehensive," "Bloomberg is inspired by demand" and "Bloomberg is challenged by ideas." Applicant respectfully requests that, in light of the additional webpages submitted, the Examining Attorney withdraws the refusal of the substitute specimen on the ground that the mark differs on the drawing and specimen. In light of the additional pages submitted, Applicant also respectfully requests that the Examining Attorney withdraw her refusal on the ground that the specimen does not show the mark in association with the services identified in the application. The fourth and fifth webpages contain links to information about societal issues in the fields of diversity and inclusion, environmental concerns, health awareness, volunteerism and philanthropy. For instance, the Bloomberg Media link indicates "Numbers tell the sustainability story. Pictures show the real world impact." The Sustaining the Arts link promotes digital engagement at the Tate Modern museum. Visitors can also click on the Sustainability News links to learn more about environmental concerns. Given the additional webpages submitted, Applicant respectfully submits that the specimen does show use of the mark in connection with the services identified in the application. |
