In response to the substantive refusal(s), please note the following:

The likelihood of confusion refusal should be withdrawn pursuant to TMEP 812.01, whereby – If applicant includes a claim of ownership of a prior registration in the application filed, the examining attorney must accept the claim without further proof of ownership and must not cite the registration for likelihood of confusion.  The claim of ownership in this response renders the refusal void.  This application should now be in condition for publication.
