DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
ISSUES APPLICANT MUST ADDRESS: On November 14, 2014, the trademark examining attorney and Ravi Malhotra discussed the issues below. Applicant must timely respond to these issues. See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.
SUMMARY OF ISSUES
In response to this Office action, applicant must address the following issues:
(1) Amendment Required – Specimen Does Not Show Use Of Mark In Connection With Services In International Class 35
(2) Clarification Required – Number Of Classes For Which Registration Is Sought
SPECIMEN DOES NOT SHOW USE OF MARK IN CONNECTION WITH SERVICES IN INTERNATIONAL CLASS 35
Please Note – The following refusal applies only to the specimen for International Class 35.
Registration is refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the services specified in International Class 35 in the application. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); In re Chengdu AOBI Info. Tech. Co., ___ USPQ2d ___, Ser. No. 77723547, 2011 TTAB LEXIS 188, at *3-6 (May 31, 2011) (redesignated precedential Sept. 5, 2014); TMEP §§904, 904.07(a), 1301.04(d), (g)(i).
Specifically, as amended, International Class 35 identifies “Service provider for sustainable development programs in the energy and natural resources space, namely, consulting services in fields of energy usage management and natural resource management in underserved communities”. The provided specimen does not contain any language referencing consulting services in fields of energy usage management and natural resource management. Accordingly, the specimen does not show use of the applied-for mark in commerce in connection with the services identified in International Class 35.
An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application. 15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and webpages that show the mark used in the actual sale, rendering, or advertising of the services. See TMEP §1301.04(a), (h)(iv)(C).
Applicant may respond to this refusal by satisfying one of the following for each applicable international class:
(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the services identified in the application.
(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required. This option will later necessitate additional fees and filing requirements such as providing a specimen.

CLARIFICATION REQUIRED – NUMBER OF CLASSES FOR WHICH REGISTRATION IS SOUGHT
Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.
ADVISORY – MULTIPLE-CLASS APPLICATION REQUIREMENTS
(1) List the services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).
(3) Submit verified dates of first use of the mark anywhere and in commerce for each international class.
(4) Submit a specimen for each international class. The current specimen is acceptable for classes 36 and 37 only.
Please Note – An additional specimen for International Class 35 is required. As explained above, the current specimen is unacceptable because it does not show use of the applied-for mark in connection with the services identified in that class.
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services.
(5) Submit a verified statement that “The specimen was in use in commerce on or in connection with the services listed in the application at least as early as the filing date of the application.”

The filing fees for adding classes to an application are as follows:
(1) A $325 fee per class, when the fees are submitted with an electronic response filed online at http://www.gov.uspto.report/trademarks/teas/response_forms.jsp, via the Trademark Electronic Application System (TEAS).
(2) A $375 fee per class, when the fees are submitted with a paper response.

APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by the individual identified in the Priority Action section above, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. TMEP §707. Any amendments to the identification of services may clarify or limit the services, but may not add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.
AMENDMENT TO IDENTIFICATION OF SERVICES
The identification of services is amended to read as follows:
Class 35 – “Service provider for sustainable development programs in the energy and natural resources space, namely, consulting services in fields of energy usage management and natural resource management in underserved communities”
Class 36 – “Service provider for sustainable development programs in the energy and natural resources space, namely, financing services for green infrastructure projects in underserved communities”
Class 37 – “Service provider for sustainable development programs in the energy and natural resources space, namely, construction project management services for green infrastructure projects in underserved communities”

If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to register, and the application fee will not be refunded. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a), 2.209(a); TMEP §§405.04, 718.01, 718.02. Where the application has been abandoned for failure to respond to an Office action, applicant’s only option would be to file a timely petition to revive the application, which, if granted, would allow the application to return to active status. See 37 C.F.R. §2.66; TMEP §1714. There is a $100 fee for such petitions. See 37 C.F.R. §§2.6, 2.66(b)(1).
