The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

Search of Office’s Database of Marks

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Significance of the Wording

 

Applicant must specify whether the wording “Dockatot” has any significance in the applicant’s trade or industry or as applied to the goods and/or services described in the application, or if such wording is a “term of art” within applicant’s industry.  See 37 C.F.R. §2.61(b); TMEP §814.

 

Failure to respond to a request for information is an additional ground for refusing registration.  See In re Cheezwhse.com, Inc., 85 USPQ2d 1917, 1919 (TTAB 2008); In re DTI P’ship LLP, 67 USPQ2d 1699, 1701 (TTAB 2003); TMEP §814.

 

Identification

 

The wording “general purpose bags and transport bags,” “Bed linens, namely, sheets, blankets and covers; sleeping bags,” “Multi-functional or multi-purpose baby pod not for medical or therapeutic purposes, for use by babies, toddlers and young children; multi-functional or multi-purpose unit consisting of mattress pad, mattress cover, bumper, handles, zippers and buckles for use by babies, toddlers and young children,” and “Clothing, namely, children's clothing” in the identification of goods is indefinite and must be clarified because it is unclear or misclassified.  See TMEP §1402.01.  The specific type and use for the bags must be more clearly indicated.  The bed linens are misclassified.  The term “baby pod” is unacceptable.  The “multi-functional or multi-purpose unit” is unclear and includes indefinite goods such as bumper, handles, zippers and buckles.  The specific type of clothing must be specified.

 

The wording “Baby Pod” in the identification of goods is a registered mark not owned by applicant.  See enclosed copy of U.S. Registration No(s). 3031738 and 3041974.  An applicant may not use a registered mark owned by another party in the identification.  A registered mark indicates origin in one party and cannot be used to define goods or services that originate in a party other than the registrant.  TMEP §1402.09; see Camloc Fastener Corp. v. Grant, 119 USPQ 264, 264 n.1 (TTAB 1958).  Therefore, applicant must amend the identification of goods to delete the wording “baby pod” and substitute the common commercial or generic name of the goods.

 

Applicant may substitute the following wording, if accurate:

 

Class 16 –

General purpose plastic bags

 

Class 18 –

Diaper bags; General purpose sport trolley bags; transport bags, namely suitcases 

 

Class 20 –

Sleeping bags; Multi-functional or multi-purpose baby bouncers not for medical or therapeutic purposes, for use by babies, toddlers and young children;

 

Class 24 –

Bed linens, namely, sheets, blankets and covers

 

Class 25 –

Children’s clothing, namely, shirts

 

An applicant may only amend an identification to clarify or limit the goods, but not to add to or broaden the scope of the goods.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.

Multiple-Class Application Requirements

 

The application identifies goods and/or services that are classified in at least 5 classes; however, applicant submitted a fee(s) sufficient for only 4 class(es).  In a multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.

 

Therefore, applicant must either (1) restrict the application to the number of classes covered by the fees already paid, or (2) submit the fees for each additional class.

 

The filing fees for adding classes to an application are as follows:

 

(1)  A $325 fee per class, when the fees are submitted with an electronic response filed online at http://www.uspto.gov/trademarks/teas/response_forms.jsp, via the Trademark Electronic Application System (TEAS).

 

(2)  A $375 fee per class, when the fees are submitted with a paper response.
