The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

IDENTIFICATION OF GOODS

 

The wording “household décor items” in the Class 020 identification of goods must be clarified because it is too broad and could include goods in other international classes.  See TMEP §§1402.01, 1402.03.  Applicant must specify the common commercial or generic name for the goods.  If there is no common commercial or generic name, applicant must describe the product and intended consumer as well as its main purpose and intended uses. 

 

The wording “decorative trays” in the Class 021 identification of goods is also indefinite and must be clarified to enable proper classification.  For example, decorative items made of made of wood and/or  plastic, not for serving food would be in Class 020.  Decorative trays for serving such as butler’s trays are in Class 021.  See TMEP §1402.01. 

 

Applicant may substitute the following wording, if accurate: 

 

Class 020

 

PICTURE FRAMES, HOUSEHOLD DÉCOR ITEMS, NAMELY [SPECIFY; E.G., PILLOWS, RESIN FIGURINES]; MIRRORS

 

Class 021

(2)       Submit a filing fee for each international class not covered by the fee(s) already paid (view the USPTO’s current fee schedule at http://www.uspto.gov/trademarks/tm_fee_info.jsp).  Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
