Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
However, before the mark can be approved for publication, the applicant must respond to the following requirements:
Identification and Classification of Services
a. The wording “representation of professional athletes in negotiations with professional sports franchises” in the identification of services needs clarification because it is too broad and could include services classified in other international classes, particularly International Class 45. See TMEP §§1402.01, 1402.03. Applicant may adopt either of the following wording in International Class 35, if accurate: “Business services provided to professional athletes, namely, the negotiation and execution of contracts with professional sports franchises”; or “Negotiation and conclusion of commercial transactions for professional athletes with professional sports franchises.” See TMEP §1402.01.
c. For assistance with identifying and classifying goods and services in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual at http://tess2.gov.uspto.report/netahtml/tidm.html. See TMEP §1402.04.
d. The application identifies services that may be classified in more than one international class; therefore, applicant must satisfy all the requirements below for each international class based on use in commerce under Section 1(a):
(1) List the goods and/or services by their international class number in consecutive numerical order, starting with the lowest numbered class.
(2) Submit a filing fee for each international class not covered by the fee already paid (view the USPTO’s current fee schedule at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp). The application identifies services that may be classified in two classes; however, applicant submitted a fee sufficient for only one class. Applicant must either submit the filing fees for the classes not covered by the submitted fees or restrict the application to the number of classes covered by the fees already paid.
(3) Submit verified dates of first use of the mark anywhere and in commerce for each international class.
(4) Submit a specimen for each international class. The current specimen is acceptable for International Class 35 and International Class 45.
Examples of specimens for services include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services.
(5) Submit a verified statement that “The specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application.”

f. If the applicant adds International Class 45 to the application, it may adopt the following identification of services in that class, if accurate: Legal services provided to professional athletes, namely, the negotiation and execution of contracts with professional sports franchises.
g. An applicant may only amend an identification to clarify or limit the services, but not to add to or broaden the scope of the services. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.
