The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Search Results
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Although no similar registered or pending mark has been found that would bar registration, applicant must satisfy/address the following Recitation of Services Requirement:
THIS PARTIAL REQUIREMENT APPLIES TO CLASSES 35 and 38 ONLY
If applicant does not respond to this Office action within the six-month period for response, the following services in International Classes 35 and 38 will be deleted from the application: “asset recovery services,” “project management services for others in the field of telecommunications,” “Relocation services for telecommunication network,” and “consignment of telecommunication equipment.” The application will then proceed with the following remaing services in Classes 35 and 38, and International Classes 36, 37 and 42. See 37 C.F.R. §2.65(a); TMEP §718.02(a).
Recitation of Services – Classes 35 and 38
The wording “asset recovery services,” “project management services for others in the field of telecommunications,” “Relocation services for telecommunication network,” and “consignment of telecommunication equipment” in the recitation of services must be clarified because it is overly broad and could include services in other international classes. See TMEP §§1402.01, 1402.03. The Applicant will need to provide more specific information regarding these services.
Applicant may substitute the following wording, if accurate:
Class 35:
Supply chain management services; supply chain logistics services; project management and staffing services for others in the field of telecommunications; asset recovery services, namely,_____{specify the nature the “assets” being recovered}; value-added reseller services, namely, distributorship services featuring telecommunication equipment; liquidation of goods for others; project management services for others in the field of telecommunications _____{further describe the nature of the telecommunication projects, as construction projects are located International Class 37}; negotiation of real estate leases for others.
Class 38:
Relocation services for telecommunication network, namely,____{further describe and detail what these services comprise and entail}; providing unified access to telecommunication networks utilizing various technologies and changing local wireless telecommunications services areas to new wireless telecommunications areas; rental of telecommunication equipment; consignment of telecommunication equipment, namely,____{further describe and detail what these services comprise and entail}; wireless broadband communication services; telecommunication services, namely transmission of video, audio, data, and voice via telecommunication networks; consulting in the field of telecommunication services, namely transmission of video, audio, data, and voice via telecommunication networks; consulting in the field of telecommunication services, namely enhanced 911 (E-911) sustainment services.
