Upon further review of the application, applicant is advised as follows (and supplementing the May 12, 2014, Office action):
SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
In this case, the following factors are the most relevant: similarity of the marks, similarity and nature of the goods and/or services, and similarity of the trade channels of the goods and/or services. See In re Viterra Inc., 671 F.3d 1358, 1361-62, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593, 1595-96 (TTAB 1999); TMEP §§1207.01 et seq.
Here, where applicant’s mark is LUNA and the registered marks are “BLACK & MILD LUNA” and “LUNA” the marks at issue create the same commercial impression for it is by LUNA that the public will recall and remember each of the marks at issue. In fact, as to U.S. Registration No. 4540148 the marks at issue are identical. It is noted that both registrations are owned by the same legal entity. Thus, where the goods are tobacco/smoking related goods, the goods are closely related and where they are identified by such similar marks are likely to be confused with each other pursuant to Section 2(d) of the Act. Please note, U.S. Registration No. 4540148 resulted from previously noted Serial No. 85/939092. See the May 12, 2014, Office action.
Serial No. 86/188589 is still pending and may be cited as a bar to the registration of this application.
