This Office action is in response to applicant’s communication filed on 12/31/2014.  The applicant submitted the foreign registration.

 

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by the applicant’s attorney, Cindy Caditz, on February 3, 2015, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

As a result of the amendments below, the refusal to register the mark under Section 2(d) in view of Registration Nos. 3310779 and 3909099 is withdrawn.

 

 

DELETION OF SECTION 1(b) BASIS

 

Section 1(b) is deleted as a basis for this application.  The application will proceed solely based on Section 44(e).   37 C.F.R. §2.35(b)(1); TMEP §806.04. 

 

 

FOREIGN REGISTRATION – STANDARD CHARACTER FORMAT

 

The foreign registration is in standard character format.  TMEP §807.03(f); App. E.

 

 

IDENTIFICATION OF GOODS

 

In Class 8, “hand staplers” is deleted from the identification of goods.

 

In Class 17, “door stops of rubber” is deleted from the identification of goods.
