STRICT DEADLINE TO RESPOND TO THIS LETTER

THIS IS A FINAL ACTION.

 

This Office action is in response to applicant’s communication filed on February 28, 2014.

 

The amended identification and the specimen for Class 44 are accepted and have been entered into the application record.

 

Applicant Must Submit A New Specimen

 

This requirement applies to Class 41.

 

Registration is refused because the specimen does not show the applied-for mark in use in commerce in connection with the services specified in International Class 41.  15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Specifically, the specimen shows that the mark is used on printed materials.  It does not show that it is used in connection with the educational services identified in Class 41.

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of goods and/or services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Examples of specimens for services may include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §§1301.04 et seq.

 

Applicant may respond to this refusal by satisfying one of the following:

 

(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the goods and/or services identified in International Class 41.

 

(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen at a subsequent date.

The requirement for an acceptable specimen is continued and now made final.

 

Response Guidelines

 

Partial Abandonment Advisory:  Applicant must respond within six months of the date of issuance of this final Office action or Class 41 will be deleted from the application by Examiner’s Amendment, and the application will then proceed with Class 44 only.  37 C.F.R. §2.65(a); see 15 U.S.C. §1062(b).

 

Applicant may respond by providing one or both of the following:

 

(1)  A response that fully satisfies all outstanding requirements;

 

(2)  An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.
