Applicant has firsthand knowledge that the failure to respond to the Office Action by the specified deadline was unintentional, and requests the USPTO to revive the abandoned application.

In response to the substantive refusal(s), please note the following:

SECTION 2(d) REFUSAL

The Examining Attorney has rejected the application for Applicant’s Mark pursuant to Section 2(d) of the Trademark Act, on the grounds that Applicant’s Mark is likely to be confused with Registration No. 3596720.

The Applicant has conducted a search on the US PTO database and has been able to determine that Registration number 3596720 for the mark VIDEOLOGIA is no longer active.  A copy of the SURRENDER OF REGISTRATION FOR CANCELLATION filed in connection with this registration is attached herewith. Given that this registration is abandoned, it can no longer been seen as a bar to Registration of the Applicant’s mark.

The Applicant therefore requests that their mark be allowed.
