TRANSLATION OF FOREIGN REGISTRATION CERTIFICATE REQUIRED

 

The applicant must submit an English translation of the foreign registration.  37 C.F.R. §2.34(a)(3)(ii); TMEP §1004.01(a)-(b).  The translation should be signed by the translator.  TMEP §1004.01(b).

 

IDENTIFICATION OF SERVICES – CLASS 44

 

The identification of services is indefinite and must be clarified because the applicant must indicate whether the independent review of clinical trials is for business purposes, in which case it would be classified in Class 35, or is for the purpose of ensuring the protection of the rights and welfare of human subjects of research in which case it would be classified in Class 45.  See TMEP §1402.01.  Applicant may adopt the following identification, if accurate:

 

Business consulting and management in the field of clinical trials, namely, clinical data and regulatory submission management on behalf of medical, biopharmaceutical and biotechnology companies to assist them with clinical research, clinical trials and applications for drug approval; regulatory submission management, namely, assisting others in preparing and filing applications for new drugs with governmental regulatory bodies; Providing independent review of clinical trials involving human subjects, namely, reviewing research protocols and related information for business purposes, in Class 35;

 

Providing independent review of clinical trials involving human subjects, namely, reviewing research protocols and related information to ensure the protection of the rights and welfare of human subjects of research, in Class 45.

 

The Trademark Act requires that a trademark or service mark application must include a “specification of … the goods [or services]” in connection with which the mark is being used or will be used.  15 U.S.C. §1051(a)(2) (emphasis added), (b)(2) (emphasis added); see 15 U.S.C. §1053.  Specifically, a complete application must include a “list of the particular goods or services on or in connection with which the applicant uses or intends to use the mark.”  37 C.F.R. §2.32(a)(6) (emphasis added).  This requirement for a specification of the particular goods and/or services applies to applications filed under all statutory bases.  See 15 U.S.C. §§1051(a)(2), 1051(b)(2), 1053, 1126(d)-(e), 1141f; 37 C.F.R. §2.32(a)(6); TMEP §§1402.01, 1402.01(b)-(c).

 

An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
