Informal Issues:

 

Color Claim and Color Description – Clarification Required:

 

Please note the applicant has claimed the colors black and white.  This claim is unnecessary.  However, if the applicant intends the mark to only be in black and white, the color claim and mark description in the application must reference all the colors in the mark, including black, white and/or gray.  TMEP §807.07(d); see 37 C.F.R. §§2.37, 2.52(b)(1).

 

If black, white and/or gray are not being claimed as a color feature of the mark, applicant must state that the colors black, white and/or gray represent background, outlining, shading and/or transparent areas and are not part of the mark.  TMEP §807.07(d).

 

If the applicant proceeds to seek a color mark, applicant must provide a mark description that specifies where all the colors appear in the literal and design elements in the mark.  See TMEP §807.07(a)(ii).  The following is suggested, if accurate:

 

(1)     Color claim:  “The color(s) black and white are claimed as a feature of the mark.”; and

 

(2)     Color location statement:  “The mark consists of a dagger bearing an ohm symbol.  The dagger is surrounded by a wreath.  All designs are black on a white background.”

 

TMEP §807.07(a)(i)-(a)(ii).

 

Please note the applicant’s specimens of use show use of the mark in a variety of colors.  The examining attorney highly recommends that the color claim can be withdrawn.  If so, the applicant may submit the following description: 

 

“The mark consists of a dagger bearing an ohm symbol.  The dagger is surrounded by a wreath.”

 

Specimen of Use For International Class 35 Unacceptable – Specimen Does Not Show Mark:

 

Registration is refused because the specimen does not show the applied-for mark in use in commerce in connection with any of the goods and/or services specified in International Class 35.  15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).  Specifically, the webpage does not show the mark.

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each international class of services identified in the application or amendment to allege use.  15 U.S.C. §1051(a)(1); 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a). 

 

Examples of specimens for services may include advertising and marketing materials, brochures, photographs of business signage and billboards, and website printouts that show the mark used in the actual sale, rendering, or advertising of the services.  See TMEP §§1301.04 et seq.

 

Applicant may respond to this refusal by satisfying one of the following:

 

(1) Submit a different specimen (a verified “substitute” specimen) that (a) was in actual use in commerce at least as early as the filing date of the application or prior to the filing of an amendment to allege use and (b) shows the mark in actual use in commerce for the goods and/or services identified in International Class 35.

 

(2) Amend the filing basis to intent to use under Section 1(b), for which no specimen is required.  This option will later necessitate additional fee(s) and filing requirements such as providing a specimen at a subsequent date.

Recitation of Services – Clarification Required:

 

The International Class 35 identification of services is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

An application must specify, in an explicit manner, the particular goods or services on or in connection with which the applicant uses, or has a bona fide intention to use, the mark in commerce.  See 15 U.S.C. §1051(a)(2), (b)(2); 37 C.F.R. §2.32(a)(6); TMEP §1402.01.  Therefore, proper punctuation in identifications of goods and services is necessary to delineate explicitly each product or service within a list and to avoid ambiguity.  Generally, commas should be used (1) to separate a series of related items identified within a particular category of goods or services, (2) before and after “namely,” and (3) between each item in a list of goods or services following “namely.”  TMEP §1402.01(a).  Semicolons generally should be used to separate a series of distinct categories of goods or services within an international class.  Id.

 

For example, the identification of goods “cleaners, namely, glass cleaners, deodorizers for pets, cosmetics” is ambiguous because “cosmetics” and “deodorizers for pets” are not “cleaners,” and thus are not within this category of goods even though they are all in the same international class.  Id.  However, by replacing the commas with semicolons after “glass cleaners” and “deodorizers for pets,” this identification would become acceptable:  “cleaners, namely, glass cleaners; deodorizers for pets; cosmetics.”  Id.

 

Please note:  In accordance with the abovementioned requirements, the examining attorney has indicated acceptable changes to the applicant’s recitation of services below in bold font.  Applicant may adopt the following identification of services, if accurate:

 

Class 35: On-line retail store services featuring On-line retail store services featuring vaporizers, portable vaporizers, accessories for vaporizers, electronic cigarettes, hand operated atomizers, chemical flavorings in liquid form used to refill hand operated atomizers, vaporizers, and electronic cigarettes; On-line retail store services featuring electronic cigarette batteries, battery chargers for electronic cigarette batteries, USB chargers for electronic cigarette batteries, car chargers for electronic cigarette batteries; On-line retail store services featuring cartridges for refilling chemical flavorings in liquid form used to refill hand operated atomizers, vaporizers, and electronic cigarettes; On-line retail store services featuring vaporizer holders in form of wood and/or metal; On-line retail store services featuring vaporizer holding cases”

 

Please note International Classes 09, 30 and 34 are acceptable without further amendment.

Please note that, while the identification of services may be amended to clarify or limit the goods, adding to the services or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification

 

Response Guidelines for TEAS-Plus Applicants:

 

TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE:  TEAS Plus applicants should submit the following documents using the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html:  (1) written responses to Office actions; (2) preliminary amendments; (3) changes of correspondence address; (4) changes of owner’s address; (5) appointments and revocations of attorney; (6) amendments to allege use; (7) statements of use; (8) requests for extension of time to file a statement of use, and (9) requests to delete a §1(b) basis.  If any of these documents are filed on paper, they must be accompanied by a $50 per class fee.  37 C.F.R. §§2.6(a)(1)(iv) and 2.23(a)(i).  Telephone responses will not incur an additional fee.  NOTE:  In addition to the above, applicant must also continue to accept correspondence from the Office via e-mail throughout the examination process in order to avoid the additional fee.  37 C.F.R. §2.23(a)(2).
