OFFICE ACTION

STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

ISSUE/MAILING DATE: 8/7/2013

Applicant is encouraged to email the trademark examining attorney at eli.hellman@uspto.gov to resolve the issues raised below.  If the suggestions listed below are acceptable, then the examiner will issue an examiner’s amendment and approve the application for publication.

The referenced application has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

No Similar Marks to Bar Registration

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

  1. Claim of Ownership of Prior Registrations

If applicant owns U.S. Registration Nos. 2888282, 3235413, 3410201 & OTHERS, then applicant must submit for the application record a claim of ownership of these registrations.  See 37 C.F.R. §2.36; TMEP §812.  See the attached copies of the registrations.  See TMEP §812.

Applicant may use the following format to claim ownership of these registrations:

Applicant is the owner of U.S. Registration Nos. 2888282, 3235413, 3410201 & OTHERS.

  1. Clarification of the Identification of Goods Required

The wording in the identification of goods is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must amend the identification to specify the common commercial name of the goods.  If there is no common commercial name, applicant must describe the product and its intended uses.  See id.

The purpose of the identification of goods is to provide the general population, including consumers and members of the relevant industry, with an understandable description of the goods, which is done by using the common commercial name for the goods.  In re Gulf Coast Nutritionals, Inc., 106 USPQ2d 1243, 1247 (TTAB 2013) (citing In re Sones, 590 F.3d 1282, 1289, 93 USPQ2d 1118, 1124 (Fed. Cir. 2009)).  If there is no common, ordinary name for the goods, applicant should describe the goods using wording that would be generally understood by the average person.  See Schenley Indus., Inc. v. Battistoni, 112 USPQ 485, 486 (Comm’r Pats. 1957); Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954); TMEP §1402.01.

An in depth knowledge of the relevant field should not be necessary for understanding a description of the goods.  TMEP §1402.01.  “[T]echnical, high-sounding verbiage” should be avoided.  Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ at 322.

For assistance with identifying and classifying goods in trademark applications, please see the USPTO’s online searchable U.S. Acceptable Identification of Goods and Services Manual at http://tess2.gov.uspto.report/netahtml/tidm.html.  See TMEP §1402.04.

Applicant may adopt the following, if accurate:

International Class 009:        Apparatus for recording, transmission or reproduction of sound or images; audio books in the field of {indicate subject matter, e.g., drama, comedy}; audio recordings featuring {specify subject matter, e.g., music}; audio and visual recordings featuring {specify subject matter, e.g., music, feature films in the field of drama}; video game software; computer programs and software for {specify the function of the programs, e.g., use in database management, use as a spreadsheet, word processing, etc. and, if software is content- or field-specific, the content or field of use}; consumer electronics and accessories therefor, namely, {indicate the common commercial name for the goods, e.g., computers, computer carrying cases}; eyeglasses and sunglasses and accessories therefor, namely, {indicate the common commercial name for the goods, e.g., eyeglass cases, eyeglass cords, eyeglass chains}; binoculars; decorative magnets; graduated rulers

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
