The request to divide application serial no. 85518136 filed on July 22, 2014, has been processed as follows:
(1) Parent (original) application serial no. 85/518,136 contains the following goods in International Class 25: Clothing, namely, overalls, jumpers, boxer shorts, belts, and panties; headgear, namely, caps, berets, beanies, hats, visors, headbands, or headwear; and footwear. The parent application is abandoned for the reasons stated below.
(2) Child application serial no. 85/982,653 contains the following goods in International Class 25: Clothing, namely, shirts, T-shirts, cardigans, jerseys, pants, trousers, slacks, jeans, denim jeans, shorts, tops, crop tops, tank tops, halter tops, sweat shirts, wraps, blouses, skirts, dresses, sweaters, jackets, coats, and blazers. A statement of use filed on July 22, 2014, meets the minimum filing requirements and has been placed in the child application. The statement of use will be routed to the examining attorney for examination and, if it does not meet all the statutory requirements, the examining attorney will notify the applicant.
The PARENT APPLICATION IS ABANDONED because neither a statement of use nor a request for extension of time to file a statement of use (extension request) was filed for the goods and/or services in the parent application and the time period for filing a statement of use or extension request has since expired. 37 C.F.R. §§2.88-2.89.
