I.  Claim of Ownership

 

If applicant owns U.S. Registration Nos. 3041791, 3734637, 3935447 and others, then applicant must submit for the application record a claim of ownership of these registrations.  See 37 C.F.R. §2.36; TMEP §812.  See the attached copies of the registrations.  See TMEP §812. 

 

Applicant may use the following format to claim ownership of these registrations:

 

Applicant is the owner of U.S. Registration Nos. 3041791, 3734637, 3935447 and others.

 

 

II.  Identification of Services – International Classes 35 and 45

 

Portions of the identification of services are indefinite and/or misclassified.  See TMEP §§1402.01, 1402.03.

 

 

INTERNATIONAL CLASS 35

 

Applicant has classified “identity card design services” in International Class 35; however, the proper classification is International Class 45.  Therefore, applicant must reclassify these services in the proper international class.  See 37 C.F.R. §§2.86, 6.1; TMEP §§1403 et seq.

 

 

INTERNATIONAL CLASS 45

 

Applicant submitted the following identification:  “facilitating social and business networking through the provision of data for use on business and identity cards.”

 

The identification of services is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services with more specificity.

 

 

Applicant may adopt the following identification: 

 

Business card design services (in International Class 35)

 

Providing temporary use of online non-downloadable software for creating business and identity cards for facilitating social and business networking; developing customized web pages and other data feed formats featuring user-defined information in the form of online business and identity cards for facilitating social and business networking (in International Class 42)

 

Identity card design services (in International Class 45)

 

The identification of goods and services for International Classes 16 and 40 is acceptable as submitted.

Multiple Class Application

 

If applicant chooses to adopt additional international classes, applicant must meet all the requirements below for those international classes based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)        LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS:  Applicant must list the goods and/or services by international class.

 

(2)        PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:  Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid[1] (confirm current fee information at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).
