DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Patricia M. Rehfield on August 17, 2012, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

Please note that Serial Number 85123177 is hereby withdrawn as a potential bar to the registration of the instant application due to the applicant’s amendment of the identification of goods. 

 

AMENDMENT OF THE IDENTIFICATION OF GOODS

The identification of goods is amended to read as follows: 

 

Class 7:  “Aquarium pump upgrade kits comprising propellers, magnets, screws, ceramic bearing, polymer bearing, housings, pump drivers, wireless communication module, power supplies, power cables, upgrade documentation; aquarium pumps and pump parts sold together as an integral component of pumps and pump parts, namely, foam covers, nozzles, wet-side assembly, rotors, o-ring, wet frame cover, wet frame, ceramic wet bearing, wet drive shaft, propeller, magnet, washer, plastic screws, plastic nuts, wet frame with axle, power supply, dry-side assembly, pin spacer, rubber gasket, rubber spacer, thick spacer, medium spacer, tin spacer, battery backup cable;  cable tie and mount unit specifically adapted for aquarium pumps; aquarium pumpwet-side maintenance kit comprising propeller, screws, bearings; aquarium pump wet-side assembly kit comprising aquarium pump housing, nozzle, ceramic bearing, polymer bearing, propeller, screws, gasket, o-ring, packaging”;

 

Class 9:  “Batteries used to back up aquarium pumps; electronic publications, namely, downloadable product operation manuals recorded on computer data; wireless wave drivers used to mimic ocean current in an aquarium; wireless module adapter which enables aquarium pumps to operate in a wireless environment.” See TMEP §§1402.01, 1402.01(e).
