The attached evidence from The Collins Dictionary shows that AMERICA is a generally known geographic place or location.  See TMEP §§1210.02 et seq.  The goods and/or services for which applicant seeks registration originate in this geographic place or location as shown by applicant’s corporate headquarters.  See TMEP §1210.03.  Purchasers are likely to believe the goods and/or services originate in this geographic place or location because applicant is an American corporation.  See TMEP §§1210.04 et seq. 

 

The computerized printing format for the Office’s Trademark Official Gazette requires a standardized format for a disclaimer.  TMEP §1213.08(a)(i).  The following is the standard format used by the Office:

 

No claim is made to the exclusive right to use “AMERICAN” apart from the mark as shown.

A “disclaimer” is a statement that applicant does not claim exclusive rights to an unregistrable component of a mark; it does not affect the appearance of the mark.  TMEP§1213.  An unregistrable component of a mark includes wording and designs that are merely descriptive or generic of the goods and/or services, and is wording or an illustration that others would need to use to describe or show their goods and services in the marketplace.  15 U.S.C. §1052(e); see TMEP §§1209.03(f), 1212.02(a), 1213.03 et seq.

 

 

IDENTIFICATION OF GOODS

 

The identification of goods is indefinite and must be clarified because the terms manually operated long handled tools and manually operated snow removal tools are overbroad.  See TMEP §1402.01.  Applicant may adopt the following identification, if accurate:  Manually operated long handled tools, namely, [list specific items, i.e., shovels, rakes, etc.]; manually operated snow removal tools, namely, [list specific items, i.e., snow shovels, etc.]. 

 

Although identifications of goods and/or services may be amended to clarify or limit the goods and/or services, adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.
