Request to Divide Application

To the Commissioner for Trademarks:

The following is submitted for application serial number. 85375466 :

FORM INFORMATION

Applicant respectfully requests division of the pending application to create a new application for the NOURISH mark in connection with the following services in International Class 45: "Providing personal support services for patients' parenteral and enteral therapy and families of patients, namely, emotional counseling and emotional support; providing professional personal support services for patients requiring parenteral and enteral therapy and families of patients, namely, emotional counseling and emotional support; providing patient advocate services for patients requiring parenteral and enteral therapy, namely, coordinating the procurement and administration of medication."

In view of the fact that the Examiner has maintained no objections in connection with Applicant’s services in International Class 45, Applicant respectfully requests approval of the new application for publication and registration.

For division of this application, Applicant submits payment herewith for the $100 government filing fee. To the extent any further filing fees are due at this time, Applicant hereby authorizes the Examining Attorney to withdraw payment for such government fees from USPTO Deposit Account 024467.

Contemporaneously with this Request to Divide, Applicant is filing a Notice of Appeal with the TTAB, and Request for Reconsideration to the June 14, 2012 Final Office Action.
