The identification of goods and is indefinite and must be clarified because it does not state the goods and services with the required specificity.  See TMEP §1402.01. 

 

The word “system” in the identification of goods is indefinite and must be amended to (1) list the primary parts or components of the system and (2) describe the nature, purpose, or use of the system.  TMEP §1401.05(d).  Applicant should use common generic terms to specify the parts or components of the system.  See TMEP §§1402.01, 1402.03(a).  Applicant should also classify the system in the same international class as its primary parts or components.  TMEP §1401.05(d). 

 

Additionally, the wording in the services in International Class 35 is unclear.  The nature of the operational data services is unclear, i.e., the services may be data management services, data processing services, or data collection services.

 

Applicant may adopt one or more of the following identifications, if accurate:   

 

International Class 9

 

Asset monitoring system and digital productivity tools suite comprising electronic transmitters, receivers, circuitry, microprocessors, and software and downloadable mobile software applications for {indicate the function of the software, e.g., monitoring assets productivity of {indicate the type of productivity monitored}, all for use in and incorporation into mobile construction machines

 

International Class 35

 

Providing earth moving machines operational data services, namely, data {indicate the specific nature of the data services, i.e., collection, management} for machine service and management, through components integrated into earth moving machines, namely electronic transmitters, receivers, circuitry, microprocessors and software, interacting with global positioning systems, cellular networks, wireless internet and satellite technology connected with a customer service center.

 

An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
