The present application was approved for publication on September 23, 2013; however, it was withdrawn from publication by the editors of the Official Gazette, due to an error in the identification of goods as described below.  I can approve it for publication immediately if you authorize me to enter an Examiner Amendment that resolves the issues described below.  I regret any inconvenience.

 

Requirement: Identification of Goods

THIS PARTIAL REQUIREMENT APPLIES ONLY TO THE GOODS SPECIFIED THEREIN

 

The wording “iPhone” in the identification of goods is a registered mark not owned by applicant.  See U.S. Registration Nos. 3877185, 3870782, 3870783 and others.  An applicant may not use a registered mark owned by another party in the identification.  A registered mark indicates origin in one party and cannot be used to define goods or services that originate in a party other than the registrant.  TMEP §1402.09; see Camloc Fastener Corp. v. Grant, 119 USPQ 264, 264 n.1 (TTAB 1958).

 

Therefore, applicant must amend the identification of goods to delete the wording “iPhone” and substitute the common commercial or generic name of the goods, e.g. smart phone, if accurate.

 

Similarly, the wording “Totes” in the identification of goods is a registered mark not owned by applicant.  See U.S. Registration Nos. 3182144, 1315771, 1138767 and others.  An applicant may not use a registered mark owned by another party in the identification.  A registered mark indicates origin in one party and cannot be used to define goods or services that originate in a party other than the registrant.  TMEP §1402.09; see Camloc Fastener Corp. v. Grant, 119 USPQ 264, 264 n.1 (TTAB 1958).

 

Therefore, applicant must amend the identification of goods to delete the wording “Totes” and substitute the common commercial or generic name of the goods, e.g. all-purpose carrying bags.

 

If accurate, applicant may adopt the following formulation for drafting an acceptable identification.  The suggested language has been bolded for applicant’s convenience. 

 

Class 009:    Phone cases; smart phone cases; carrying cases for cell phones; protective covers and cases for cell phones; cases for eyeglasses or sunglasses; eyeglass cases

 

Class 018:    All-purpose carrying bags, handbags, cross-body bags, imitation leather key chains, wallets including ID holders, cosmetic cases sold empty, wristlet bags, credit card cases including ID holders, coin cases, umbrellas

An applicant may amend an identification of goods and services only to clarify or limit the goods and services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
