DATABASE SEARCH: The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
APPLICATION HAS BEEN AMENDED: In accordance with the authorization granted by Steven Gray on 07/30/2013, the trademark examining attorney has amended the application as indicated below. Please advise the undersigned immediately of any objections. Otherwise, no response is necessary. TMEP §707.
COLOR CLAIM AND MARK DESCRIPTION AMENDED
The following statements describing color in the mark are added to the record:
The colors grey, blue, and white are claimed as a feature of the mark.
The mark consists of a highly stylized three dimensional rendering of "3D”, with the number "3" in grey with white shading, the letter "D" in blue, with the right side of the "3" touching the left side of the "D," and the parts that are touching being partially joined together, with the vertical bar line portion of the left side of the "D" being subsumed by the right side of the "3," except at the bottom, where the bottom horizontal line portion of the D subsumes the left of the bottom lower right hand corner of the "3". The color white appearing in the rest of the mark represents background and/or transparent areas and is not claimed as a feature of the mark.
