STRICT DEADLINE TO RESPOND TO THIS LETTER

TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

This Office action is in response to applicant’s communication filed on January 22, 2014.

 

Upon reconsideration, the Section 2(d) likelihood of confusion refusal based on U.S. Registration Nos. 2032087, 2040277 and 3024445 is withdrawn.  Also, the applicant’s amended Class 011 identification of goods and disclaimer statement have been entered.

 

However, the applicant must respond to the following requirements:

 

Identification of Goods – Clarification Required – Class 007

 

In its response, the applicant’s proposed wording “filters for fluids in hydraulic systems; filters for transmissions” in the Class 007 identification of goods is indefinite and must be clarified because it is overly broad and ambiguous.  See TMEP §1402.01.  The purpose/function of the goods must further specified to ensure proper classification of the goods.

 

Applicant may adopt the following identification of goods, if accurate: 

 

“Oil, air, fuel, and coolant filters for motors and engines; [insert clarification of “filters for fluids in hydraulic systems,” e.g., hydraulic fluid filters for motors and engines]; [insert clarification of “filters for transmissions,” e.g., transmission filters for motors and engines]; filters for engine turbochargers, in International Class 007.”

Although identifications of goods and/or services may be amended to clarify or limit the goods and/or services, adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

 

This requirement is continued and maintained.

 

Ownership of Prior Registrations

 

If applicant is the owner of U.S. Registration Nos. 2032087, 2040277 and 3024445, then applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.
