IN THE UNITED STATES PATENT AND TRADEMARK OFFICE RESPONSE TO OFFICE ACTION
In re: Trademark Application of: Mattel, Inc. 333 Continental Boulevard El Segundo, California 90245 Serial No.: 85/887178 Filing Date: March 26, 2013 Class: 41 Mark: LAUGH & LEARN Trademark Law Office: 114 Examining Attorney: Won T. Oh
Commissioner for Trademarks P.O. Box 1451 Alexandria, VA 22313-1451
Dear Sir/Madam:
This is in response to the Office Action mailed July 14, 2015.
RESPONSE The Examining Attorney has refused registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d), alleging that Applicant’s mark, when used on or in connection with the identified goods, so resembles the mark in U.S. Registration Number 4,680,211 for LAUGH & LEARN in Class 16 as to be likely to cause confusion, to cause mistake, or to deceive.
Applicant would like to direct the Examining Attorney’s attention to the following registrations:
As the Examining Attorney can see from the above, Applicant is the owner of several registrations for the same mark that is being refused. Accordingly, as these registrations harmoniously coexist on the registry with the cited registration, Applicant’s current filing for LAUGH & LEARN LOGO should be allowed the benefit of registration as well.
In view of the arguments set forth above, Applicant respectfully requests the Examining Attorney withdraw the refusal to register made under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d) and to pass this application to publication.
Respectfully submitted, |
