DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUES APPLICANT MUST ADDRESS:  On July 8, 2013, the trademark examining attorney and Angelo Bufalino discussed the issues below.  Applicant must timely respond to these issues.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

IDENTIFICATION OF GOODS

 

The wording used to describe the goods is indefinite and must be clarified because the type of nail grooming products must be specified.  See TMEP §1402.01.

 

Applicant may adopt the following if accurate:

 

Nail polish, lip gloss, lipstick, lip pencils, eye make-up, face make-up, face blush, body gels, body make-up, body glitter, nail enamel, nail hardener, nail glitter, nail lacquer, nail strengthener, nail care preparations, cuticle removing preparations, nail polish top coat, nail polish base coat, nail varnish, nail art, namely, fingernail decals, nail art stickers, nail art adhesive gems; nail grooming products, namely, __________ [please specify common commercial name (e.g. tips, glue, lacquer and glitter)]; face blush, and body paints, in International Class 3.

 

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.
