TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE: Applicants who filed their application online using the reduced-fee TEAS Plus application must continue to submit certain documents online using TEAS, including responses to Office actions. See 37 C.F.R. §2.23(a)(1). For a complete list of these documents, see TMEP §819.02(b). In addition, such applicants must accept correspondence from the Office via e-mail throughout the examination process and must maintain a valid e-mail address. 37 C.F.R. §2.23(a)(2); TMEP §§819, 819.02(a). TEAS Plus applicants who do not meet these requirements must submit an additional fee of $50 per international class of goods and/or services. 37 C.F.R. §2.6(a)(1)(iv); TMEP §819.04. In appropriate situations and where all issues can be resolved by amendment, responding by telephone to authorize an examiner’s amendment will not incur this additional fee.
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
SECTION 2(e)(1) REFUSAL – MERELY DESCRIPTIVE
Registration is refused because the applied-for mark merely describes a characteristic of applicant’s goods. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
A mark is merely descriptive if it describes an ingredient, quality, characteristic, function, feature, purpose or use of the specified goods and/or services. TMEP §1209.01(b); see In re Steelbuilding.com, 415 F.3d 1293, 1297, 75 USPQ2d 1420, 1421 (Fed. Cir. 2005); In re Gyulay, 820 F.2d 1216, 1217-18, 3 USPQ2d 1009, 1010 (Fed. Cir. 1987). Moreover, a mark that identifies a group of users to whom an applicant directs its goods and/or services is also merely descriptive. TMEP §1209.03(i); see In re Planalytics, Inc., 70 USPQ2d 1453, 1454 (TTAB 2004).
In the instant case, applicant seeks registration of BABY-BUMP SOUND SYSTEM for “Abdominal belts containing built-in speakers for purposes of transmitting music/sounds/educational material to a fetus and built-in pockets in which to carry audio transmitters; Audio and video recordings featuring music and artistic performances; Audio recordings featuring music, voice messages; Audio speakers that may be attached with adhesive to the abdominal area of pregnant women for the purpose of transmitting music/sounds to the fetus, not for medical purposes; Audio tapes featuring music; Cases for music, audio and related electronic equipment, namely, cases for audio tuners, audio receivers, amplifiers, tape players, compact disc players, MP3 controllers/players, audio mixers, audio speakers in the nature of music studio monitors, microphones, audio speakers, compact discs, audio tapes, portable computers, antennas, phonographic record players, audio recording equipment, and the cables associated with all of the foregoing equipment; Children's educational music CDs and DVDs; Compact disc players; Compact discs featuring music; Compact discs featuring music and spoken word in the form of poetry; Computer hardware and software for processing digital music files; Computer programs for processing digital music files; Computer software and firmware for downloading or streaming audio or music files; Computer software featuring musical sound recordings and musical video recordings; Computer software for creating and editing music and sounds; Computer software for processing digital music files; Digital music downloadable from the Internet.”
The term “BABY BUMP” is defined as “visible signs of pregnancy, noticeable abdominal swelling in a pregnant woman” (see attached). The term BABY BUMP is commonly used by news publications to refer to a pregnant women’s abdominal or belly area (see attached examples). The term “SOUND SYSTEM” is defined as “a set of electronic equipment used for playing recorded music or for making a speaker's voice louder” (see attached).
The applicant’s goods are a SOUND SYSTEM composed of custom speakers that gently adhere to a pregnant women’s BABY BUMP and plays music, soothing sounds and/or voice messages directly to the womb (see attached page from applicant’s website and amazon page showing a women wearing the applicant’s goods on her pregnant belly or BABY BUMP). Additionally, the applicant’s computer software, audio recordings, music and sound system accessories such as cases are used in connection with the applicant’s speakers or SOUND SYSTEM.
Terms that describe the function or purpose of a product may be merely descriptive. TMEP §1209.03(p); see, e.g., In re Hunter Fan Co., 78 USPQ2d 1474, 1477 (TTAB 2006) (holding ERGONOMIC merely descriptive of ceiling fans); In re Wallyball, Inc., 222 USPQ 87, 89 (TTAB 1984) (holding WALLYBALL merely descriptive of sports clothing and game equipment); In re Orleans Wines, Ltd., 196 USPQ 516, 517 (TTAB 1977) (holding BREADSPRED merely descriptive of jams and jellies).
Accordingly, registration on the Principal Register must be refused under Trademark Act Section 2(e)(1).
Advisory – Supplemental Register Suggested
The applied-for mark has been refused registration on the Principal Register. Applicant may respond to the refusal by submitting evidence and arguments in support of registration and/or by amending the application to seek registration on the Supplemental Register. See 15 U.S.C. §1091; 37 C.F.R. §§2.47, 2.75(a); TMEP §§801.02(b), 816. Amending to the Supplemental Register does not preclude applicant from submitting evidence and arguments against the refusal(s). TMEP §816.04.
Applicant is advised that, if the application is amended to seek registration on the Supplemental Register, applicant must disclaim “SOUND SYSTEM” because such wording appears to be generic in the context of applicant’s goods and/or services. See 15 U.S.C. §1056(a); In re Wella Corp., 565 F.2d 143, 196 USPQ 7 (C.C.P.A. 1977); In re Creative Goldsmiths of Wash., Inc., 229 USPQ 766 (TTAB 1986); TMEP §1213.03(b).
