The above-referenced application is abandoned because applicant’s response to the previous Notice of Incomplete Response was untimely. See 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a); TMEP §718.02.
To avoid abandonment of applicant’s trademark application, the USPTO must have received a properly signed response within (1) thirty (30) days of the date of issuance of the Notice of Incomplete Response, or (2) the time remaining in the six-month period for responding to the previous Office action, whichever was longer. In the present case, the trademark examining attorney issued the Notice of Incomplete Response on January 2, 2014; therefore, applicant was required to submit a proper response on or before January 31, 2014. However, applicant filed a late response on February 4, 2014. Because applicant did not file a proper response within the deadline, the application is being held abandoned. See 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a).
If applicant’s delay in submitting the response was unintentional, applicant may file a petition to revive the abandoned application. 37 C.F.R. §2.66(a); TMEP §§718.02, 1714. The petition must be filed within two months of the date of issuance of this letter and may be filed online at http://www.gov.uspto.report/trademarks/teas/petition_forms.jsp. See 37 C.F.R. §2.66(a)(1); TMEP §1714.01(a), (d). A $100 fee for such a petition is required. See 37 C.F.R. §2.6(a)(15).
