The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).

Classification of Goods
Applicant has classified “disposable test strips for use in conjunction with blood glucose meters” in International Class 10; however, the proper classification is International Class 05. Therefore, applicant must either (1) add International Class 05 to the application and reclassify these goods in the proper international class, or (2) delete the wording “disposable test strips for use in conjunction with blood glucose meters” from the application. See 37 C.F.R. §§2.86, 6.1; TMEP §§1403 et seq. If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.
The filing fees for adding classes to an application are as follows:
(1) $325 per class, when the fees are submitted with an electronic response filed online at http://www.gov.uspto.report/teas/index.html, via the Trademark Electronic Application System (TEAS); or
(2) $375 per class, when the fees are submitted with a paper response.

Applicant may adopt the following classification of goods, if accurate:
Class 05
Disposable test strips for use in conjunction with blood glucose meters
Class 10
Blood glucose meters; blood glucose monitoring system with blood glucose meters, glucose test strips and lancets

Additions to Identification Not Permitted
An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq.

Section 1(b) Requirements for Combined Applications
For an application with more than one international class, called a “multiple-class application,” an applicant must meet all of the requirements below for those international classes based on an intent to use the mark in commerce under Trademark Act Section 1(b):
(1) LIST GOODS/SERVICES BY INTERNATIONAL CLASS: Applicant must list the goods and/or services by international class; and
(2) PROVIDE FEES FOR ALL INTERNATIONAL CLASSES: Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.uspto.gov, click on “View Fee Schedule” under the column titled “Trademarks”).
See 15 U.S.C. §§1051(b), 1112, 1126(e); 37 C.F.R. §§2.34(a)(2)-(3), 2.86(a); TMEP §§1403.01, 1403.02(c).
The applicant must provide the information requested below pursuant to the authority granted the examining attorney by 37 C.F.R. § 2.61(b). The applicant must directly answer the following questions:
Does the design element have any significance as applied to the goods other than trademark significance?
Does the design element have any significance in the relevant trade or industry other than trademark significance?
Is the design element a symbol? What is the symbol’s name? What is the meaning of the symbol?
Failure to respond to a request for information can be grounds for refusing registration. TMEP §814; see In re DTI P’ship LLP, 67 USPQ2d 1699, 1701-02 (TTAB 2003). Merely stating that information about the goods or services is available on applicant’s website is an inappropriate response to a request for additional information, and is insufficient to make the relevant information of record. See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004).
Color Claim and Mark Description Incomplete
Applicant must amend the color claim and mark description to identify all the colors in the mark drawing. See 37 C.F.R. §2.52(b)(1); TMEP §807.07(a)-(a)(ii). The following colors have been omitted from the color claim: orange and black. In addition, the following colors have been omitted from the mark description: orange and black.
A complete color claim must reference all the colors appearing in the drawing of the mark. See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq. Similarly, a complete mark description for a mark depicted in color must identify all the literal and design elements in the mark and specify where the colors appear in those elements. See 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a) et seq. However, if black, white, and/or gray are not being claimed as a color feature of the mark, applicant must exclude them from the color claim and include in the mark description a statement that the colors black, white, and/or gray represent background, outlining, shading, and/or transparent areas and are not part of the mark. See TMEP §807.07(d).
The following color claim and mark description are suggested, if accurate:
The colors orange and black are claimed as a feature of the mark. The mark consists of a circle with a line underneath the circle in the color orange, with the word “DARIO” written underneath in the color black.
