In the Office action of May 22, 2013, the applicant was advised that both prior pending application Serial Nos. 85796967 and 85722131 may present a bar to registration. Application Serial No. 85722131 has since matured into registration. In order to avoid piecemeal prosecution of the present application, it is suspended pending the outcome of Serial No. 85796967. Thus, any Section 2(d) Refusal related to application Serial No. 85722131 (Registration No. 4349300) will issue when Serial No. 85796967 has either been abandoned or matured into registration. The applicant should also note that the Examiner’s Amendment of sent earlier today resolves the issues regarding the identification and classification of services.
The trademark examining attorney is suspending action on the application for the reason(s) stated below. See 37 C.F.R. §2.67; TMEP §§716 et seq.
The USPTO will periodically conduct a status check of the application to determine whether suspension remains appropriate, and the trademark examining attorney will issue as needed an inquiry letter to applicant regarding the status of the matter on which suspension is based.
