THIS IS A FINAL ACTION.
This Office action is in response to applicant’s communication filed on 10/25/2013. The applicant (1) amended the identification of goods and services, (2) providing color claim and mark description, and (3) claimed ownership of prior registrations. Only Nos. 1 and 3 are acceptable.
Drawing and Color Location Statement Clarification Required – Final Action
The mark description and the drawing of the mark remain unacceptable because the drawing contains a dotted/dashed line in white that either needs to be included in description or deleted altogether. Further, the wording referencing a “background of no particular shape” coupled with a drawing showing such dotted or dashed lines is simply confusing. The applicant must amend the mark description and drawing to clearly and succinctly state what colors are claimed as features of the mark and where the colors appear on the mark. If the term “FAB” and heart design are to appear in the color white on a black background, the dotted lines must be deleted from the drawing. There is no reason to indicate a background has no particular shape because that is already understood to be the case. But the addition of the white dashed lines indicates the wording will appear on a black background within a rectangle outlined by the white dashed lines.
If color is a feature of the mark, applicant must (a) submit a substitute color drawing that agrees with the colors in the color claim, (b) ensure that the color claim lists all the colors that are claimed as a feature of the mark, and (c) submit a statement describing the literal and design elements in the mark that specifies where all the colors appear in those elements. 37 C.F.R. §§2.37, 2.52(b)(1); see TMEP §807.07(a)-(a)(ii). Generic color names must be used to describe the colors in the mark, e.g., magenta, yellow, turquoise. TMEP §807.07(a)(i)-(ii). If black, white, and/or gray are not being claimed as a color feature of the mark, applicant must exclude these from the color claim and include in the mark description a statement that the colors black, white, and/or gray represent background, outlining, shading, and/or transparent areas and are not part of the mark. See TMEP §807.07(d). The following color claim and mark description are suggested, if accurate:
Color claim: “The colors black and white> are claimed as a feature of the mark.”
Mark description: “The mark consists of the following: the wording “FAB” adjacent to the design of a heart in the color white on a black background.”

Unless the white dotted/dashed lines are also a feature of the mark, the applicant must submit a new drawing that shows the term “FAB” and heart design on a solid black background.
If no new drawing is submitted deleting these lines, they must be claimed or described in the mark description, for example, “The mark consists of the following: the wording “FAB” adjacent to the design of a heart in the color white on a black rectangular background outlined by white dashed lines.
Options
Applicant must respond within six months of the date of issuance of this final Office action or the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond by providing one or both of the following:
(1) A response that fully satisfies all outstanding requirements;
(2) An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.

In certain rare circumstances, an applicant may respond by filing a petition to the Director pursuant to 37 C.F.R. §2.63(b)(2) to review procedural issues. 37 C.F.R. §2.64(a); TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters). The petition fee is $100. 37 C.F.R. §2.6(a)(15).
TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE: Applicants who filed their application online using the reduced-fee TEAS Plus application must continue to submit certain documents online using TEAS, including responses to Office actions. See 37 C.F.R. §2.23(a)(1). For a complete list of these documents, see TMEP §819.02(b). In addition, such applicants must accept correspondence from the Office via e-mail throughout the examination process and must maintain a valid e-mail address. 37 C.F.R. §2.23(a)(2); TMEP §§819, 819.02(a). TEAS Plus applicants who do not meet these requirements must submit an additional fee of $50 per international class of goods and/or services. 37 C.F.R. §2.6(a)(1)(iv); TMEP §819.04. In appropriate situations and where all issues can be resolved by amendment, responding by telephone to authorize an examiner’s amendment will not incur this additional fee.
