DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

ISSUE APPLICANT MUST ADDRESS:  On March 14, 2013, the trademark examining attorney and Sally Abel discussed the issue below.  Applicant must timely respond to this issue.  See 15 U.S.C. §1062(b); 37 C.F.R. §2.62(a); TMEP §§708, 711.

The mark on the specimen disagrees with the mark on the drawing.  In this case, the specimen displays the mark without gray shadowing below the square, whereas the drawing shows the mark with gray shadowing below the square.

 

An application based on Trademark Act Section 1(a) must include a specimen showing the applied-for mark in use in commerce for each class of goods and/or services.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).  The mark on the drawing must be a substantially exact representation of the mark on the specimen.  37 C.F.R. §2.51(a); TMEP §807.12(a); see 37 C.F.R. §2.72(a)(1).  In addition, the drawing of the mark can be amended only if the amendment does not materially alter the mark as originally filed.  37 C.F.R. §2.72(a)(2); see TMEP §§807.12(a), 807.14 et seq.

 

Therefore, applicant must submit one of the following:

 

(1)  A new drawing of the mark that agrees with the mark on the specimen (i.e., no gray shadowing below the square) but does not materially alter the original mark.  See 37 C.F.R. §2.72(a)(2); TMEP §§807.12(a), 807.14 et seq.  Amending the drawing to agree with the specimen would not be considered a material alteration of the mark in this case, OR

 

(2)  A substitute specimen showing use in commerce of the mark on the drawing, and the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:  “The substitute specimen was in use in commerce at least as early as the filing date of the application.”  See 37 C.F.R. §§2.59(a), 2.193(e)(1); TMEP §§807.12(a), 904.05.  If submitting a specimen requires an amendment to the dates of use, applicant must also verify the amended dates.  37 C.F.R. §2.71(c); TMEP §904.05.

 

Please note that if applicant chooses option number (2) above, then applicant must also amend the mark description to reference the shadow design element in order to provide a complete mark description.  37 C.F.R. §2.37; see TMEP §§808.01, 808.02.  Therefore, if applicant keeps the original drawing and submits a substitute specimen, the following mark description is suggested: The mark consists of a house comprising a roof and chimney over three arcs forming a wireless signal symbol, all above the word “LINKSYS” and set against a square background with rounded corners.  Shadows that reflect part of the square appear below the square.

 

Pending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a trademark.  Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
