ARGUMENT(S)

Applicant has deleted from the application the following goods: "Plastic garbage and lawn bags for individual consumer use and sold through retail stores".  Applicant understands that these were the goods that resulted in the refusal of the present application over Registration Nos. 3040866 and 4079789 for the mark WAVERLY PLASTICS.

 

Accordingly, Applicant respectfully submits that, with the deletion of the conflicting goods, the refusal should be withdrawn.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Applicant has deleted from the application the following goods: "Plastic garbage and lawn bags for individual consumer use and sold through retail stores".  Applicant understands that these were the goods that resulted in the refusal of the present application over Registration Nos. 3040866 and 4079789 for the mark WAVERLY PLASTICS.

 

Accordingly, Applicant respectfully submits that, with the deletion of the conflicting goods, the refusal should be withdrawn.
