TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
Identification
The wording in the identification of is indefinite and overbroad and must be clarified and restricted to the classes in the application or another class added as necessary. See TMEP §1402.01. Applicant must amend the identification to specify the common commercial name of the services. If there is no common commercial name, applicant must describe the type of service activity. See id.
Applicant may adopt the following:
Class 36: Provision of email alerts to consumers regarding medical financial transactions, health insurance charges, and insurance reimbursements
Class 42: Computer services, namely, provision of web services and application programming interfaces in the field of medical transactions, health insurance charges, insurance reimbursements, and fraud prevention; providing temporary use of online computer software allowing consumers to monitor and review their medical financial transactions, health insurance charges, and insurance reimbursements; providing temporary use of online computer software allowing consumers to detect and report unauthorized or fraudulent medical transactions, health insurance charges, and insurance reimbursements; consulting, monitoring and reporting services in the fields of fraudulent transactions, identity theft, insurance fraud and financial crimes
Therefore, applicant must submit samples of advertisements or promotional materials for the identified services. If such materials are not available, applicant must submit samples of advertisements or promotional materials for similar services. In addition, applicant must describe in detail the nature, purpose and channels of trade of the services.
(1) LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS: Applicant must list the goods and/or services by international class.
(2) PROVIDE FEES FOR ALL INTERNATIONAL CLASSES: Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).
